ENFORCEMENT OFFICER’S VIOLATION REPORT:
Mr.
Massoud reviewed the monthly report with the commission
highlighting a memo from the assistant ZEO, Paul Liphardt
indicating a list of all businesses along
As
a result of these violations he has drafted a letter alerting businesses to the
circumstances under which temporary signs may be allowed.
The
Zoning Officer’s report for the month of April was received as presented.

Aquifer Protection District
#2
Mr.
Massoud noted this month’s discussion was a continuation
from the previous months meeting, citing a need to better establish the
boundary and review the aquifer district regulations.
As
Steve Trinkaus, Chairman of the Water Pollution
Control Authority could not attend the meeting Mr. Massoud
briefly reiterated the proposed amendments to the zoning regulations and zoning
aquifer map.
Chairman
Giroux remarked as there is an immediate need to hold a public hearing to
permanently establish the mapping, any future corrections and or issues can be
dealt with if they so arise at that time.
A
referral will be made to the Planning Commission and the public hearing date
was set for June 11, 2008 meeting.
Zoning permits related to
minor construction activities
As
the Building Official, Mark Cody could not attend the meeting all discussion
was deferred to next months meeting.
Temporary structures
Mr.
Massoud offered examples of zoning regulations from
several towns defining structures and temporary structures.
Southbury
residents Stan Prybylski and Bob Wheeler offered
comments regarding a past issue Mr. Prybylski had
with a neighbor constructing a Quonset hut type temporary structure to close to
the property line which ended in the removal of the structure as of a result of
a one line survey showing non-conformity with property line setbacks.
A
brief discussion took place and the commissioners agreed to further investigate
the apparent need for changes to the regulations.
As
directed by the commission Mr. Massoud will draft a
definition for structures, for review by the land use consul.
Farmer’s Market
As
Mr. Massoud was directed by the commission at the
previous months meeting to establish a section within the zoning regulations by
which a farmer’s market would be
allowed, he offered Schedule A, Line B-1 all buildings, uses and
facilities of the Town of
The
commission discussed the term “uses” and its meaning. Chairman Giroux believed the term “uses” was
too broad.
Discussion
continued with regard to other town approved functions and how they fit into
the zoning regulations. Some
commissioners voiced there disappointment in that the commission was not given
a formal presentation explaining the concept of the farmer’s market.
A
consensus of the commission determined a public hearing would be needed to add
appropriate language and a definition to the regulations allowing the town to
establish a farmer’s market. A need for
referral’s to both the Planning Commission and Fire Marshal was discussed.
Mark
Massoud was instructed to compile a proposed draft
for next months meeting and will consult with the land use attorney.
Willow Creek Farm –
Lighting of the outdoor riding ring
Mr.
Massoud offered information from the PDD #19 regulations
noting neither the outdoor ring nor the lighting is addressed.
After
some discussion the commission determined all lighting at the site must comply
with Section 11 of the regulations. As
the outdoor ring lighting is not addressed the owner would possibly need to
return submit to the commission a modification to the detailed plans for the
site.
As
directed by the commission the Zoning Officer will send out a notice of
violation.
